TAJAN acts as the seller's agent. The auctioneer is not a party to the sales contract which exclusively unites the seller and the purchaser. GENERAL These general terms and conditions of sale, the sale and all that relates to them are governed by French law; Sellers, buyers and their agents accept that any legal action falls within the exclusive jurisdiction of the courts within the jurisdiction of Paris (France). The provisions of these general conditions are independent of each other. The sale is made in cash and the prices are expressed in euros (€). GUARANTEES The seller warrants to TAJAN and the buyer that he is the undisputed owner, or that he is duly mandated by the undisputed owner, of the goods offered for sale, which are not subject to any claim, dispute or seizure, nor any reservation or pledge and that he can validly transfer the ownership of the said goods. The indications appearing in the catalog are established by TAJAN and the Expert, who assists it if necessary, with all the diligence required by a SVV of furniture at public auctions, subject to the notifications, declarations, rectifications, announced at the time of the presentation of the object and recorded in the minutes of the sale. This information, including the dimensional indications appearing in the catalog are provided to facilitate the inspection of the potential purchaser and remain subject to his personal appreciation. The absence of indication of a restoration of use, accidents, alterations or any other incident in the catalog, on condition reports or labels, or even during verbal announcement does not imply that a good is free from defect. No claim will be accepted once the auction has been announced, a prior exhibition having allowed the purchasers to examine the works presented. For objects whose low estimate amount exceeds €1,000 appearing in the sales catalogue, a condition report on the state of conservation of the lots may be communicated on request. The information contained therein is provided free of charge and for information purposes only. These do not in any way engage the responsibility of TAJAN. In the event of disputes, particularly regarding the authenticity or origin of the items sold, TAJAN is bound by an obligation of means; its possible liability can only be incurred on the express condition that a personal and proven fault is demonstrated against it. Jewelery and Watches: Customers who so wish can request a certificate for any non-certified stone by sending a request to the Jewelery department at least two weeks before the date of the sale. No guarantee is made on the working condition of the watches. Watches cannot be guaranteed to be water resistant and the buyer is advised to consult a watchmaker before using the item. ESTIMATES AND RESERVE PRICE The estimated selling price is shown next to each lot in the catalogue, it does not include any costs to be borne by the buyer or VAT. The reserve price is the confidential minimum price agreed with the seller below which the property will not be sold. The reserve price may not be higher than the low estimate appearing in the catalog or publicly announced by the authorized auctioneer and recorded in the minutes. In the event that a property does not include a reserve price, TAJAN shall not be held liable vis-à-vis the seller in the event of the sale of the property concerned at a price lower than the low estimate published in the catalog of sale. AUCTIONS For a good organization of the sales, the bidders are invited to make themselves known to TAJAN before the sale, in order to allow the recording of their personal data. Auctions follow the order of catalog numbers. TAJAN is free to set the order of auction progression and bidders are required to comply with it. The highest and last bidder will be the successful bidder. In the event of a dispute at the time of the auctions, i.e. if it is established that two or more bidders have simultaneously made an equivalent bid, and claim this object at the same time after the word "adjugé" has been pronounced, the said object will be immediately put up for sale at the price proposed by the bidders and all the amateurs present will be able to compete for this second auction. By placing a bid, the bidder assumes personal responsibility for paying the hammer price, plus the costs payable by the buyer and any taxes or duties payable; he assumes full responsibility, unless he has previously had TAJAN register a regular mandate specifying that the auction is carried out for the benefit of an identified third party. In the event that a reserve price has been stipulated by the seller, TAJAN reserves the right to bid on behalf of the seller until the reserve price is reached. Any person who has registered with TAJAN has the right to access and rectify the personal data provided to TAJAN under the conditions of the Data Protection Act of January 6, 1978 amended by the law of August 6, 2004. ORDERS PURCHASE AND BIDDING BY TELEPHONE For large purchases, a letter of credit from the Bank may be requested. In the case of several identical purchase orders, the first to arrive will have preference. Bids by telephone are allowed for customers who cannot travel. Bids by telephone are only admissible for lots whose low estimate is greater than €400. This is a free service rendered to the customer. TAJAN, its agents or its employees will not bear any responsibility in the event of error or omission in the execution of the orders received, as in the event of non-execution of these.
